Protecting the privacy of your Personal Information (as defined below) is the responsibility of Giant Manufacturing Co. Ltd. and all of its affiliates (collectively, "Giant Group”, “we”, “our”, or “ours”).

To better inform you of your rights and foster trust between us during your use of Giant RideFusion APP (the “RideFusion APP”) and the various other services that we offer, we have crafted this Privacy and Security Policy (this “Policy”). Please read this Policy carefully, and your continued use of our services will be deemed your (a) acceptance of this Policy and (b) consent to provide Personal Information (as defined below) to us.

Why we collect your Personal Information

We may ask you to provide information by which you may be personally identified (collectively, “Personal Information"). To enhance the quality of our service and tailor it to your personal needs, we collect your Personal Information for the following purposes:

(1)     To maintain and keep up-to-date your membership registration, including to verify the accuracy, recency and validity of information provided by you;

(3)     To provide customer support for the RideFusion APP and Giant’s power meter, and to enhance the quality of our products and services;

(4)     To send you communications regarding marketing and promotion;

(5)     To customize the content and discounts that we provide to you;

(6)     To utilize for data compilation and analysis, so to improve our products and services; and

(7)     To fulfill or comply with applicable requirements under the law, including but not limited to conducting investigations, protecting Giant Group’s or a third party’s rights and assets, protecting the safety of individuals and the public, to prevent, avoid or mitigate illegal, fraudulent, immoral or other acts that may be subject to prosecution.

We may disclose Personal Information provided by you to third parties for verification of your identity to prevent identity theft or similar violation of your rights. We will protect your Personal Information in strict accordance with applicable law, and you may decide whether to disclose certain information to us. Note, however, that should you decide not to provide certain information to us, the scope and availability of services that we may be able to provide to you may be limited.

How we collect Personal Information

We collect Personal Information through your:

·        Registration for a Giant ID

·        Amendments to your Personal Information

• When you log into the RideFusion APP for the first time, we will ask you to provide certain Personal Information such as gender, birthday, height, weight and Functional Threshold Power (FTP), to enhance the accuracy of our analysis of your athletic performance.
  若您第一次登入RideFusion APP，我們將要求您輸入性別、生日、身高、體重、FTP等個人資訊，以提升各項運動分析之準確性。

·        Bike ride data

• If you would like to connect the RideFusion APP to an external device (e.g., Power Meter or Smart Trainer), we will request access to Bluetooth on the device to connect the RideFusion APP to it and enable our service. At any time, you may remove access to Bluetooth or disconnect the RideFusion APP from any external device.

• If you would like to enable location tracking in the background of our service (e.g., begin recording a bike ride), we will collect your Personal Information during your use of the service. Such Personal Information includes GPS, your riding speed, etc. We will utilize the activity information in the background to provide you specific services. At any time, you may turn off the background location tracking on your device.

• During your use of our service, we will collect and use the location information of your device, including your route. We will use various technologies to identify your location, including GPS, any WiFi hot spot to which you connect your device in order to use our service, and by measuring the location of your cell phone through its base station.

• We also collect and use information on your use activity while in the RideFusion APP, and certain other information about your mobile device, including any device identification code, operating system, model, build, settings, etc., to ensure smooth running of our service on your device and personalize your user experience.

What types of Personal Information we collect

Through the above collection methods, we may gather Personal Information from you that includes but is not limited to:

·        Personally identifying information: name, email address, GIANT ID, social media login information, home telephone number, mobile phone number, mailing address, residential address, photographs, videos, etc.;

·        Personal descriptions: gender, birthday, height, weight, etc.; and

·        Bike riding activity and physical performance data: FTP, span, bike ride time and duration, cadence, name of the equipment used to generate cadence, heart rate, name of the equipment used to generate heart rate, accumulative distance, speed, name of the equipment used to measure speed, power, name of the equipment used to measure power, balance between left and right pedals, latitude, longitude, altitude, efficiency quotient, smoothness of left and right pedaling, drag on the smart trainer, ERG on the smart trainer, slope of the smart trainer, wind speed of the smart trainer, etc.
·        騎行活動及體能數據：FTP、跨高、當下時間、騎乘累積秒數、踏頻、踏頻數據來源的設備名稱、心率、心率數據來源的設備名稱、累積距離、當前速度、速度數據來源的設備名稱、當前功率、功率數據來源的設備名稱、左右踏板平衡數值、緯度、經度、海拔、效率係數、左、右腳踩踏平滑度、當前智能訓練台阻力、ERG設定值、坡度設定值及風速設定值等

How long Personal Information is stored and used, geographical limits, with whom it is shared, and how it is shared
個人資料保存、利用期間、地區、對象及方式

·        How long it is stored and used: to provide you with our service and fulfill the purposes for which your Personal Information is collected, we will store and use your Personal Information. At any time, you have the right to exercise any of your rights listed below under the heading “What you can do with the Personal Information that is shared with us”; the aforementioned storage and use period is ten (10) years from the date the Personal Information concerned is last modified, not from the date when you register as a user.
·        保存及利用期間：為向您提供服務並履行蒐集目的，我們將會保存及利用您的個人資料，以持續提供服務，但您有權隨時向本集團申請行使同本聲明中「客戶個人資料之權利」段所述之權利；上述保存及利用期間之認定為，最後異動日起算10年，非由註冊日期起算。

·        Geographical limits: Personal Information will be used at various locations around the world where we have operations, to provide users with relevant services.

·        With whom it is shared, and how it is shared

• We and our business partners that help us provide you with our service, including sales agents and dealers of Giant-brand products and developers of cloud-based services available via the APP, will assist you with anything that concerns your membership registration, provide you with analysis of your bike rides and athletic performance, maintain the cloud-based services and monitor the security of the systems, and generally provide any and all services and product support.
• 由本集團及協助本集團向您提供服務之合作夥伴，包括Giant品牌產品之代理商/經銷商、APP雲端服務之開發商等，將協助處理您的會員註冊事宜、提供您騎乘過程中的騎乘分析及騎乘結束後的運動分析、負責雲端管理與安全監控、提供各項服務及產品支援、解決您的疑問。
  
  
• We will use your Personal Information for the promotion and marketing of products and services offered by us and our designated partners, sales agents/dealers and other affiliates.
• 介紹與行銷產品及服務，如本集團及與本集團有特約合作關係之第三人及本集團之簽約商、代理商/經銷商、關聯公司與合作夥伴所提供之產品和服務。
  
  
• We will use your Personal Information to process and transfer essential information across borders to our personnel, agents, and third parties that assist in our provision of services to you. We will endeavor to ensure that our employees, agents and those third parties that assist in our provision of services to you are all subject to the same privacy policies here.
• 將您所提供之個人資料，進行電腦處理、跨境傳輸必要資訊予本集團人員、代理人員、及協助本集團向您提供服務之合作夥伴等，以利提供及優化產品和服務。本集團將盡力確保本集團員工、代理人員、及協助本集團向您提供服務之合作夥等遵守隱私政策條款。

Without your consent, we will not disclose any of your Personal Information to any third party not in any way related to our provision of products or services to you, nor will we use any of your Personal Information for any purpose not mentioned above, except as required by law enforcement or other government authorities in their investigation or use.

What you can do with the Personal Information that is shared with us

With respect to any Personal Information shared with us by you, you may, in accordance with the law:

·        Request for copies of Personal Information;

·        Request for supplementation or correction of Personal Information;

·        Limit automated decisions made with respect to Personal Information;

You may exercise any of your rights listed above in the following manner. If you have any questions, please contact the RideFusion APP support team via email. Upon verification of your identify, we will attend to your needs as expeditiously as possible. If you do not provide sufficient or accurate information for identity verification, such that we are unable to verify your identity, then we may be unable to help you with your privacy claims.
您可透過下列說明方法行使上述權利，如有問題，請email與RideFusion APP管理團隊聯繫，經確認您的身分無誤後，本集團將迅速進行處理。如果您提供的個人資料不正確或不完整（如使用暱稱），致本集團無法確定您的真實身分，本集團將無法配合您的隱私權主張。

1. Review or request for inspection of Personal Information

In the RideFusion APP, after logging in, you may navigate to bike ride data page to view your personal records. You may also look up your information on the user information page.
在RideFusion APP中，您可以於登入後，前往騎乘紀錄頁面查詢個人的騎乘紀錄；於使用者資訊頁面可以查詢個人的資料。

2. Request for copies of Personal Information

In the RideFusion APP, you may retrieve information from the bike ride data page. The information retrieved may be downloaded to your device in CSV or FIT format.
在RideFusion APP中，您可以於騎乘紀錄頁面提交下載騎乘資料，導出的資訊以CSV或FIT檔案格式下載至您的裝置。

3. Request for supplementation or correction of Personal Information

In the RideFusion APP, you may supplement or correct any Personal Information on the user information page.
在RideFusion APP中，您可以於使用者資訊頁面提交補充或更正個人資訊。

4. Request that we cease collecting, processing or otherwise using Personal Information

At any time from your mobile phone, you may erase any Personal Information saved on the RideFusion APP.
您可以隨時於手機端對RideFusion APP上的個人資料進行清除。

5. Request for restrictions on processing Personal Information

Your continued use of the RideFusion APP is deemed your consent to our collection, processing and use of your Personal Information through the RideFusion APP. If you would like to restrict our authority in this regard, please contact us. We will promptly attend to your restriction request. Please note, however, that restrictions on our authority with respect to your Personal Information may result in a corresponding restriction on the functions available to you on the RideFusion APP, such that your rights and experience as a user may be affected.
當您使用RideFusion APP，即視為同意授予本集團透過APP蒐集、處理、使用您個人資訊的權限，如您要求限制本集團透過APP可蒐集、處理、使用您個人資訊的權限，請與本集團聯繫，本集團將協助儘速處理您的限制請求；但若完成權限限制後，APP僅能提供有限的對應功能，且可能影響您的使用權利及體驗。

6. Limit automated decisions made with respect to Personal Information

The RideFusion APP does not make any automated decisions. During your use, you may decide manually whether to save certain information, such as bike ride data, Personal Information and network connection settings.
RideFusion APP未進行自動化決策，當您使用RideFusion APP時，可自行選擇是否儲存資訊，包含騎乘數據、個人資料、連線設定。

7. Request for deletion of Personal Information

In the RideFusion APP, you may request for deletion of your user account. Upon deletion, all of the information saved in your account will be deleted in its entirety, save for any information that we may keep as permitted under applicable law.
在RideFusion APP中，您可以提交個人帳號的刪除請求，刪除後您的個人帳戶下所有資料將完整刪除，惟於法律允許之情況下，本集團將例外暫予保留。

8. Request for transportation of Personal Information

In the RideFusion APP, you may request for transportation of your Personal information, including your bike ride data. The information you request to transport will be immediately downloaded to your device in CSV format.
在RideFusion APP中，您可以提交個人資訊與騎乘數據資料的攜出請求。您要求攜出的資訊會立即作為CSV文件下載至您的裝置。

Email notification
電子郵件的傳送

Your email address that we collect pursuant to “How we collect Personal Information” will be used for all email communication sent from us. We will send you emails about your transaction details, our terms of service and special deals. We will note clearly in any email sent to you that it was sent by us.
本集團依據「個人資料蒐集方式」取得您的電子郵件帳號，為提供交易資訊、服務或優惠權益，將傳送前述相關內容之電子郵件給您，並在該電子郵件上註明是由本集團所發送的。

Data analysis
資料剖析

Some of our contractors, sales agent/dealers, affiliates and other partners may access your Personal Information. We will use this information to observe the effectiveness of our marketing efforts, and will share our observations with the aforementioned third parties for similar purposes. We will use information collected by third parties to better tailor our services to your personal needs.

·        If you would like to opt out of our marketing emails, you may do so in the RideFusion APP.
·        欲取消行銷/促銷訊息遞送，請於RideFusion APP中逕行設定。

Protecting yourself
自我的保護

Please keep all of your personal information, add-on services and other network services safe at all times. Do not share any such information with any other person. After each instance of amending your user information, log out of the device on which the amendment was done. If you are using a shared or public computer, always log out and close out of your Internet browser to prevent others from accessing and using your personal information.
請妥善保管您的任何個人資料、附加服務與各類網路服務，不要將任何個人資料提供給任何人。在您完成會員聯絡等相關資訊變動等程序後，務必記得登出，若您是與他人共享電腦或使用公共電腦，切記要登出及關閉瀏覽器，以防止他人蒐集並使用您的個人資料。

Protection of privacy for minors
未成年人隱私權保護政策

If you are a minor using our services, we will protect your privacy in accordance with this Policy. If you register as a user on the RideFusion APP, pursuant to applicable law, we will also collect, process, use and/or disclose to third parties your Personal Information and information on your family members. You may still exercise any of the rights listed under the “What you can do with the Personal Information that is shared with us” heading at any time.
對於未成年使用者使用本集團之各項服務時，本集團將依本聲明保護使用者之隱私權。如您為未成年使用者，註冊並使用RideFusion APP，本集團將依法對您進行個人及家庭成員資料之蒐集、處理、使用及/或向第三者揭露，但您亦得向本集團申請就個人資料行使同本聲明中「客戶個人資料之權利」段所述之權利。

Using the RideFusion APP on third-party products and services
以第三方產品和服務使用 RideFusion APP

The RideFusion APP allows you to interface with various other digital products and services. For instance, you may connect the RideFusion APP to a third-party device to follow activities on social media and other digital services. Your privacy rights on such third-party platforms will be subject to the policies of these third-party platforms. We disclaim any and all liability with respect to the use of any third-party platform or application not owned by us, or the privacy policies of such third-party platforms or applications.
RideFusion APP能讓您與多種其他數位產品和服務互動 (例如:您將RideFusion APP與第三方裝置整合或連結，用於活動追蹤、社群網路服務和其他數位服務)，您在第三方平台上的隱私權會由他們的相關政策決定，對於任何非屬本集團擁有而連結至的網站或應用程式，本集團對其內容、網站或應用程式上的任何使用情況，或該等網站或應用程式的隱私做法不予以負責。

Amendments to this Policy

We may update this Policy from time to time. We will post any updated Policy on this page. If we make material changes to this Policy, we will inform you by providing notice on our website, the GIANT ID platform’s system updates page, or on the RideFusion APP. We will also inspect this Policy from time to time to ensure its compliance with all applicable law.
本集團可逕行修訂本隱私權保護/安全聲明內容，新的內容將會呈現於此網頁。當本集團針對本隱私保護及安全聲明有大幅度修改時，為維護您的權益，本集團會在網頁上、GIANT ID平台系統訊息公告處或RideFusion APP張貼變更告示，以讓您知曉相關事項。本集團亦定期檢視隱私權保護/安全聲明以符合相關法律規範。
