GENERELLE BETINGELSER FOR ANPARTSSELSKABET GIANT EUROPE B.V.s FORBRUGERE med hjemsted i Lelystad, registreret under handelsregisternummer (39042936)
1 Betingelsernes anvendelighed
1.1 Foreliggende betingelser glder for alle aftaler, inklusive fjernsalgsaftaler samt ethvert tilbud og enhver (rets)handling som kan have en sdan fjernsalgsaftale til flge, (herunder enhver ndring af eller supplement til en aftale, samt alle (rets)handlinger, som forbereder eller gennemfrer denne aftale, inklusive foreliggende betingelser og de eventuelle vrige specifikationer og betingelser, som glder for aftalen) [som er indget med Giant Europe B.V.] (herefter kaldet: "Giant"), og enhver aftale mellem Giant og en forbruger som ikke handler som led i udvelsen af sit erhverv eller virksomhed, hvor Giant har erklret, at foreliggende betingelser glder, medmindre parterne udtrykkeligt skriftligt har fraveget foreliggende betingelser.
1.2 Der foreligger en fjernsalgsaftale, hvis der inden for rammerne af et system, som Giant har opbygget, vedrrende fjernsalg af produkter og/eller tjenester, udelukkende er anvendt fjernkommunikationsteknisk udstyr fra starten til indgelsen af aftalen, alts uden fysisk mde mellem forbrugeren og (medarbejderne hos) Giant.
1.3 Fr en fjernsalgsaftale indgs stilles teksten i foreliggende generelle betingelser elektronisk til rdighed for forbrugeren, s teksten p en let mde kan gemmes af forbrugeren. Hvis det rimeligvis ikke er muligt at stille foreliggende generelle betingelser til rdighed for forbrugeren p ovennvnte mde, skal der inden fjernsalgsaftalen indgs, meddeles at de generelle betingelser ligger til gennemsyn hos Giant og p anmodning kan fremsendes gratis hurtigst muligt.
1.4 Aftalen mellem forbrugeren og Giant kommer i stand, efter at forbrugeren elektronisk har modtaget kvitteringen for Giants modtagelse af forbrugerens accept.
2 Tilbud
2.1 De tilbud, som Giant afgiver, er uforpligtende. De glder i 30 dage, medmindre andet skriftligt er anfrt. Priserne i et tilbud er i euro og eksklusive moms.
2.2 Hvert tilbud indeholder information, s rettighederne og forpligtelserne i forbindelse med accepten af tilbuddet er tydelige for forbrugeren. Informationen skal frem for alt indeholde en komplet produktbeskrivelse, prisen inklusive skatter, eventuelle omkostninger i forbindelse med leveringen, den mde aftalen indgs p og hvilke handlinger dette krver, om forbrugeren eventuelt har fortrydelsesret, den mde betaling, levering og gennemfrelse af aftalen foregr p, acceptfristen eller betalingsfristen, taksten for fjernsalgskommunikation, hvis omkostningerne for brugen af teknisk udstyr i forbindelse med fjernsalgskommunikation beregnes p et andet grundlag end den almindelige basistakst der glder for det anvendte kommunikationsmiddel, om aftalen arkiveres efter indgelsen, og i bekrftende tilflde, hvordan forbrugeren kan f adgang dertil, og desuden hvordan forbrugeren inden indgelsen af aftalen kan kontrollere og, om nsket, rette de oplysninger, som han har givet i forbindelse med aftalen, og fjernsalgsaftalens mindste lbetid sfremt der er tale om et lbende kontraktforhold.
3 Aftale
3.1 De tilbud, som Giant viser, binder Giant ikke og glder kun som en opfordring til at afgive en ordre, som frst resulterer i en aftale mellem parterne, efter at Giant har accepteret og bekrftet pgldende ordre skriftligt og pbegynder gennemfrelse af denne. Giant vil i s fald beregne sig den pris, som hndteres iflge Giants mest aktuelle prisliste. Giant bestrber sig p, at prislisten p Giants hjemmeside hele tiden viser de mest aktuelle priser i euro, men forbeholder sig ret til at fravige den viste pris, isr hvis de viste priser p grund af teknisk fejl eller tredjemands handlinger ikke stemmer overens med Giants mest aktuelle prislist. I forekommende tilflde vil Giant informere forbrugeren. I et sdant tilflde kan forbrugeren pberbe sig ret til at ophve aftalen. Hvis denne ret ikke udves inden 8 dage efter Giants meddelelse, vil Giant gennemfre aftalen iflge bestemmelsen i foreliggende paragraf.
3.2 Under forbehold af ovenstende, kommer en aftale desuden i stand p det tidspunkt, hvor forbrugeren accepterer et tilbud og opfylder de betingelser, som i den forbindelse er stillet. Hvis forbrugeren har accepteret tilbuddet elektronisk, bekrfter Giant omgende elektronisk modtagelsen af accepten af tilbuddet. S lnge modtagelsen af denne accept ikke er bekrftet, kan forbrugeren annullere aftalen.
3.3 Hvis aftalen indgs elektronisk, trffer Giant passende tekniske og organisatoriske forholdsregler med henblik p sikring af den elektroniske overfrsel af data og srger for et sikkert netvrksservermilj. Hvis forbrugeren nsker at betale elektronisk, skal Giant ivrkstte passende forholdsregler.
3.4 Giant skal i forbindelse med produktet eller tjenesten give forbrugeren flgende information alts skriftligt eller p en sdan mde, at forbrugeren kan gemme denne information p en tilgngelig mde p et holdbart datamedium: Giants afdelings besgsadresse, hvor forbrugeren kan henvende sig til i tilflde af klager, desuden betingelserne og fremgangsmden for brug af fortrydelsesretten, eller en klar meddelelse om, at fortrydelsesretten er udelukket, information om tilgngelig service efter kbet, og endvidere garantier, oplysningerne jf. foreliggende aftales 2, stk. 2, medmindre Giant allerede har givet forbrugeren disse oplysninger forud for gennemfrelsen af aftalen, og ydermere de krav, der glder for opsigelse af aftalen, sfremt aftalen har en varighed p mere end 1 r eller glder p ubestemt tid.
3.5 Giant kan inden for lovens rammer undersge forbrugerens muligheder for at overholde betalingsforpligtelserne, desuden alle forhold og faktorer som er vigtige til at sikre, at fjernsalgsaftalen indgs p et forsvarligt grundlag. Hvis Giant p grund af denne undersgelse har gode grunde til at undlade at indg aftalen, er den berettiget til at afvise en ordre eller foresprgsel med anfrelse af begrundelsen herfor, eller knytte specielle betingelser til gennemfrelsen.
3.6 Uanset ovenstende kan Giant tilbyde produkter eller tjenester, hvis priser pvirkes af bevgelserne p det finansielle marked som Giant ikke har nogen indflydelse p, for variable priser. Denne pvirkning af bevgelser og det faktum, at eventuelt anfrte priser er vejledende priser, meddeles i forbindelse med tilbuddet.
4. Levering
4.1 Levering sker ab Giants lager [i Lelystad, Holland] eller et andet sted, som Giant bestemmer i den forbindelse, medmindre andet er aftalt skriftligt.
4.2 Hvis der, som afvigelse fra ovenstende, skriftligt er aftalt n af Incoterms-betingelserne, glder de Incoterms-betingelser fra International Chamber of Commerce, der p tidspunktet for indgelsen af aftalen er gldende.
4.4. Hvis der p noget tidspunkt hos Giant opstr begrundet tvivl om forbrugerens kreditvrdighed, er Giant berettiget til, inden den foretager (yderligere) ydelser, at krve fra forbrugeren, at denne foretager forudbetaling eller stiller sikkerhed, som svarer til de, eventuelt forfaldne, belb, som Giant har til gode hos forbrugeren eller vil kunne krve, alt efter Giants skn.
4.5 Hvis forbrugeren ikke betaler p forfaldsdagen, er Giant berettiget til at ngte enhver yderligere levering af varer eller tjenester indtil fuldstndig betaling har fundet sted.
5. Fortrydelsesret
5.1 Under henvisning til den hollandske civillovs (BW) 7:46d, stk. 4, litra b, 1. punkt, er forbrugeren ikke berettiget til at ophve aftalen, hvis der er tale om produkter, der er fremstillet efter specifikationer.
5.2 I tilflde af kb af (uspecificerede) produkter har forbrugeren mulighed for at ophve aftalen uden begrundelse inden 7 (syv) dage. Denne frist lber fra dagen efter, forbrugeren eller en reprsentant, som forbruger i forvejen har udpeget og meddelt Giant har modtaget produktet.
5.3 I denne frist skal forbrugeren omhyggeligt hndtere produktet og emballagen. Han m kun pakke produktet op eller bruge det i den grad det er ndvendigt at kunne vurdere, om han nsker at beholde produktet. Hvis han udver sin fortrydelsesret, skal han returnere produktet vedlagt alt tilbehr, som er leveret, og hvis det rimeligvis er muligt i den oprindelig stand og emballage til Giant, i overensstemmelse med Giants rimelige og tydelige instrukser.
5.4 Hvis forbrugeren udver sin fortrydelsesret, er hjst omkostningerne af tilbageforsendelsen for hans regning.
5.5 Hvis forbrugeren har betalt et belb, refunderer Giant dette belb hurtigst muligt, dog senest inden 30 dage efter tilbageforsendelsen eller fortrydelsen.
6. Leveringstid
6.1 Giant oplyser leveringstiderne tilnrmelsesvis og efter bedste viden, men de er ikke bindende for Giant. Overskridelse af den oplyste leveringstid giver forbrugeren ret til at ophve aftalen, dog frst efter at Giant har fet et skriftligt varsel med en rimelig frist for at opfylde aftalen, og der fortsat ikke er leveret inden denne frist. Forbrugeren vil i et sdant tilflde hverken have krav p nogen skadeserstatning medmindre det er fastsat i en lovbestemmelse, eller ret til at undlade at opfylde en forpligtelse, som han har p grund af aftalen.
6.2 Hvis leveringen er forsinket i forhold til den meddelte, formentlige leveringsdato, som er omhandlet i forrige stykke, skal Giant informere forbrugeren herom.
6.3 Den formentlige leveringstid, som Giant har meddelt, starter p det tidspunkt, hvor Giant skriftligt har bekrftet forbrugerens accept af tilbuddet og har modtaget alle oplysninger og hjlpemidler, som er ndvendige i forbindelse med leveringen, fra forbrugeren.
6.4 Under iagttagelse af bestemmelserne herom i foreliggende generelle betingelser, vil Giant gennemfre accepterede ordrer hurtigst muligt, dog senest inden 30 dage, medmindre en lngere leveringstid er aftalt. Hvis leveringen er forsinket, eller hvis en ordre ikke eller kun delvist kan gennemfres, fr forbrugeren besked herom senest 1 mned efter afgivelsen af ordren. Forbrugeren har i s fald ret til at ophve aftalen uden omkostninger. I tilflde af ophvelse jf. dette stykke, refunderer Giant det belb, som forbrugeren har betalt, hurtigst muligt, dog senest inden 30 dage efter ophvelsen.
6.5 Giant har til enhver tid ret til at gennemfre en aftale i dele og krve betaling for den del af aftalen, som er gennemfrt. I tilflde af delleveringer betragtes disse som vre baseret p srskilte aftaler, som er omfattet af foreliggende betingelser.
7 Billeder, tegninger, modeller osv.
7.1 Billeder, tegninger, oplysninger om ml og vgt, modeller eller prver leveres kun af Giant til forbrugeren som en yderligere oplysning. Typen af den leverede vare kan afvige fra billedet, tegningen, oplysninger om ml og vgt, modellen eller prven, medmindre udtrykkeligt skriftligt er meddelt, at der leveres i overensstemmelse med de oplysninger, der er givet.
8 Garanti
8.1 Alle Giants produkter er omfattet af bestemmelserne i [Giants garantiprogram], medmindre udtrykkeligt skriftlig andet er aftalt. For det vrige glder, at betingelserne og garantierne fra producenter og tredjemand, der leverer varer til Giant, finder anvendelse. Giant informerer forbrugeren p dennes anmodning om anvendeligheden af og indholdet i den garanti, som disse producenter og tredjemand giver, sfremt denne garanti findes.
8.2 Garanti fra Giant, producenten eller importr pvirker ikke de lovbestemte rettigheder og krav, som forbrugeren p grund af aftalen kan gre gldende over for Giant.
9 Ejendomsforbehold
9.1 Alle de varer, som Giant leverer, forbliver dens ejendom indtil forbrugeren har opfyldt alle forpligtelser (uanset deres art) i den aftale, som er indget med Giant. Dette ejendomsforbehold omfatter ogs krav i forbindelse med forsmmelse af overholdelsen af den aftale, der er omhandlet i denne paragraf, herunder krav p skadeserstatning og godtgrelse af udenretslige og retslige omkostninger, kontraktuel og lovbestemte rente, samt bder og tvangsbder.
10 Mangler/klagefrister
10.1 Forbrugeren skal omhyggeligt (lade) undersge de kbte varer p tidspunktet for leveringen. I den forbindelse skal forbrugeren kontrollere, om de leverede varer opfylder aftalen, alts: - om de korrekte varer er leveret; - om det antal varer, der er leveret, er i overensstemmelse med det antal, som er anfrt p det ledsagende fragtbrev.
10.2 Hvis der konstateres, at emballagen har skader, eller at der er et utilstrkkeligt antal, s skal forbrugeren straks efter leveringen meddele Giant disse synlige mangler eller det utilstrkkelige antal telefonisk og efterflgende skriftligt inden 5 hverdage efter leveringen.
10.3 Ikke-synlige mangler ved de leverede varer skal forbrugeren straks efter opdagelsen meddele Giant telefonisk og efterflgende bekrfte telefonisk inden 7 dage derefter, sdan forstet, at sdanne mangler skal meddeles Giant senest inden 3 mneder efter levering til forbrugeren.
10.4 Efter konstatering af enhver mangel skal forbrugeren omgende indstille brugen af de(t) pgldende produkt(er) og desuden gre og/eller undlade alt det, som er rimeligvis muligt for at undg (yderligere) skade. 10.5 Giant er ikke ansvarlig for pgldende mangel, hvis forbrugeren ikke overholder stk. 1-4 i denne paragraf.
11 Inkassoomkostninger
11.1 Hvis forbruger forsmmer eller misligholder n eller flere af sine betalingsforpligtelser og efter et varsel ikke har betalt det skyldige belb inden 14 dage, s er alle rimelige, udenretslige omkostninger, jf. Rapport Voorwerk II (retningslinje fra den hollandske dommerforening angende vurderingen af strrelsen p udenretslige inkassoomkostninger) for forbrugerens regning. I hvert fald skal forbrugeren, med et minimum p EUR 40,--, betale 15 % af de frste EUR 2.500,-- og 10 % af de flgende EUR 2.500,--. Hvis Giant pviser, at den har pdraget sig strre omkostninger, som rimeligvis var ndvendige, kommer ogs disse i betragtning.
12 Ansvar
12.1 Giants samlede ansvar i forbindelse med skadeserstatning er altid begrnset til fakturavrdien af det, som Giant har leveret til forbrugeren, og som danner grundlag for kravet. Under ingen omstndigheder vil den samlede skadeserstatning vre hjere end det, som Giant i den forbindelse fr udbetalt af sit forsikringsselskab, idet Giant er forpligtet til at opretholde en ordentlig forsikring.
12.2 Giants ansvar for direkte skade er udelukket, medmindre der er tale om forst eller grov uagtsomhed eller dette ansvar p anden mde flger af en lovbestemt forpligtelse til skadeserstatning. Ved direkte skade forsts udelukkende: a) skade p genstande, hvorved forsts materiel skade, mangelfuldhed eller ikke funktionerende, samt materiel skade p forbrugerens eller tredjemands andre ejendele; b) omkostninger i forbindelse med ndvendige ndringer og/eller forandringer i udstyr med henblik p at begrnse henholdsvis udbedre direkte skade; c) rimelige udgifter til faststtelse af rsagen til og omfanget af skaden, sfremt denne faststtelse vedrrer en direkte skade jf. denne paragraf; d) rimelige udgifter til forebyggelse eller begrnsning af skade, sfremt forbrugeren har pvist, at disse udgifter har resulteret i en begrnsning af direkte skade jf. denne paragraf.
12.3 Medmindre ufravigelig lov ikke tillader en begrnsning af erstatningsansvar, er Giants samlede ansvar for skade som flge af dd eller personskade, uanset bestemmelserne i denne paragraf, maksimalt det, som den i den forbindelse fr udbetalt af sit forsikringsselskab, idet Giant er forpligtet til at opretholde en ordentlig forsikring.
12.4 Giants erstatningsansvar for indirekte skade: herunder alle andre skader end flgeskader, tabt fortjeneste, tabte opsparinger, driftstab, skade i forbindelse med tab af data, miljskade og/eller immateriel skade er udelukket.
12.5 Eventuelle sagsanlg i forbindelse med skade bortfalder efter 12 mneder efter opdagelsen af skaden.
13 E-mail-beskeder
13.1 En e-mail-besked inden for rammerne af foreliggende generelle betingelser og alle aftaler kan ligestilles med en skriftlig erklring.
13.2 I tilflde af en tvist om, om e-mail-beskeder er modtaget eller ej, eller er sendt eller ej, giver Giants logfile-data tvingende bevis.
13.3 E-mail-beskeder anses at vre modtaget nr de er tilgngelige for den anden part, herunder i hvert fald det tidspunkt, hvor de har net frem til mailboksen af den modtagende part.
14 Telekommunikationsfaciliteter
14.1 Den part, der gr brug af telekommunikationsfaciliteter, er ansvarlig for valget heraf. Hvis Giant gr brug af telekommunikationsfaciliteter, er Giant, sfremt der i forbindelse med overfrsel af data opstr skade p dataet eller forsinkelse af fremsendelsen, kun ansvarlig for den skade, som flger heraf uden at det berrer de vrige bestemmelser i de generelle betingelser sfremt der kan krves erstatning for denne skade hos pgldende telekommunikationsudbyder, medmindre der findes et lovbestemt grundlag, som gr at Giant er forpligtet til at yde skadeserstatning.
15 Materialer og digital information
15.1 Alle materialer og digital information, der vedrrer ordren, og som i den forbindelse skal stilles til rdighed for forbrugeren, skal p forbrugerens frste anmodning overdrages til ham, dog kun efter at forbrugeren har opfyldt alle sine forpligtelser over for Giant. Omkostninger i forbindelse med de dertil ndvendige datamedier er for forbrugerens regning. Det samme glder for forbrugeren, nr det glder materialer og digital information fra Giant, medmindre andet er aftalt.
16 Oplysninger og filer
16.1 Foreliggende betingelser glder for de hjemmesider, som Giant driver, og for alle tjenester, som Giant tilbyder og leverer via internet. 16.2 Giant behandler forbrugerens oplysninger strengt fortroligt. De videregives ikke til tredjemand, medmindre Giant er forpligtet dertil i medfr af loven, eller leveringen af tjenester krver det. Giant hndterer som minimum de gldende lovbestemte regler for beskyttelse af privatlivet.
16.3 Hvis forbrugeren giver oplysninger til Giant, gemmes disse i en fil. Hvis forbrugeren afgiver en ordre via en af Giants hjemmesider, registrerer Giant ordren med et navn. Forbrugerens oplysninger videregives ikke til tredjemand, medmindre gennemfrelsen af forbrugerens ordre krver dette.
16.4 Filen med forbrugerens ordrer anvendes ogs til fremsendelse af personlige tilbud til forbrugeren, medmindre forbrugeren via Giants hjemmeside angiver at have indvendinger imod dette. Filen kan ogs bruges til statistiske analyser og personlige analyser.
17 intellektuelle ejendomsrettigheder.
17.1 Hvis forbrugeren sender en besked til Giant, f.eks. med det forml at offentliggre beskeden p en af Giants hjemmesider, giver forbrugeren dermed Giant ret til at offentliggre, mangfoldiggre og/eller redigere beskeden (inklusive det navn, som forbrugeren angiver), uden forpligtelse til nogen nrmere bestemt godtgrelse.
17.2 Alle intellektuelle ejendomsrettigheder i forbindelse med Giants hjemmesider, herunder programmer, tekster, billeder og lyde tilhrer Giant og/eller den, som Giant har fet licens af. Dette indebrer bl.a., at det ikke er tilladt at offentliggre, mangfoldiggre og/eller redigere den information, som str p Giants hjemmesider, uden Giants tilladelse, medmindre det er til eget brug.
18 Sikkerhed
18.1 De oplysninger, som forbrugeren giver til Giant angende bankkontonumre eller kreditkort sendes via et sikker protokol over nettet. De vrige registreringer og ordrer sendes ikke sikret.
18.2 Giant udfrer periodisk en virusscanning for at sikre s meget som muligt, at Giants hjemmesider er og forbliver frie for vira. Giant kan imidlertid ikke give nogen garanti for, at hjemmesiderne er frie for vira.
19 Information via Giants hjemmesider
19.1 Den information, som forbrugeren finder p Giants hjemmeside er sammensat med stor omhyggelighed. Giant kan imidlertid ikke give nogen garanti for, at informationen p hjemmesiden til enhver tid er komplet og korrekt. Forbrugeren er som bruger til enhver tid selv ansvarlig for sine egne beslutninger og de deraf flgende og dermed sammenhngende handlinger, ogs hvis disse beslutninger er taget p basis af informationen p Giants hjemmeside.
19.2 Information p Giant hjemmesider opdateres periodisk. Det samme glder for de generelle betingelser og de betingelser, der glder for de andre tjenester, som tilbydes via hjemmesiderne. De ndrede betingelser trder i kraft s snart disse offentliggres p hjemmesiden.
19.3 Hvis forbrugeren stder p fejl p Giants hjemmesider, vrdstter Giant det i hj grad, hvis forbrugeren meddeler dette til Giant.
19.4 Hvis Giants hjemmesider indeholder links til tredjemands hjemmesider, er det vigtigt, at Giant s omhyggeligt muligt vlger de hjemmesider, som der linkes til. Giant kan imidlertid ikke give nogen garanti for indholdet i og funktionen af tredjemands hjemmesider.
20 Tvister og gldende lov
20.1 P alle aftaler mellem Giant og forbrugeren finder udelukkende [hollandsk ret] anvendelse. De Forenede Nationers konvention om aftaler om internationale kb (den internationale kbelovskonvention) finder ikke anvendelse. Alle tvister som udspringer af en aftale, som er omfattet af foreliggende generelle betingelser, inklusive tvister om eksistens og gyldighed heraf, afgres af den kompetente afdeling i retten i Zwolle-Lelystad.

Data relating to our Sites and Apps: device type; operating system; browser type; browser settings; IP address; language settings; dates and times of connecting to a Site; App usage statistics; App settings; dates and times of connecting to an App; location data, and other technical communications information (some of which may constitute Personal Data); username; password; security login details; usage data; aggregate statistical information.
Employer details: where you interact with us in your capacity as an employee of a third party, the name, address, telephone number and email address of your employer, to the extent relevant.
Content and advertising data: records of your interactions with our online advertising and content, records of advertising and content displayed on pages or App screens displayed to you, and any interaction you may have had with such content or advertising (e.g., mouse hover, mouse clicks, any forms you complete in whole or in part) and any touchscreen interactions.
Views and opinions: any views and opinions that you choose to send to us, or publicly post about us on social media platforms.

(G) Disclosure of Personal Data to third parties

third party Processors (such as payment services providers; shipping companies; etc.), located anywhere in the world, subject to the requirements noted below in this Section (G);
any relevant party, law enforcement agency or court, to the extent necessary for the establishment, exercise or defence of legal rights;
any relevant party for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties;
any relevant third party acquirer(s), in the event that we sell or transfer all or any relevant portion of our business or assets (including in the event of a reorganization, dissolution or liquidation); and
any relevant third party provider, where our Sites and our Apps use third party advertising, plugins or content. If you choose to interact with any such advertising, plugins or content, your Personal Data may be shared with the relevant third party provider. We recommend that you review that third party’s privacy policy before interacting with its advertising, plugins or content.
If we engage a third-party Processor to Process your Personal Data, the Processor will be subject to binding contractual obligations to: (i) only Process the Personal Data in accordance with our prior written instructions; and (ii) use measures to protect the confidentiality and security of the Personal Data; together with any additional requirements under applicable law.

(I) International transfer of Personal Data
Summary – International transfer of Personal Data We transfer Personal Data to recipients in other countries. Where we transfer Personal Data from the EEA to a recipient outside the EEA that is not in an Adequate Jurisdiction, we do so on the basis of Standard Contractual Clauses.
Because of the international nature of our business, we transfer Personal Data within the Giant group, and to third parties as noted in Section (G) above, in connection with the purposes set out in this Notice. For this reason, we transfer Personal Data to other countries that may have different laws and data protection compliance requirements to those that apply in the country in which you are located.
Where we transfer your Personal Data from the EEA to recipients located outside the EEA who are not in Adequate Jurisdictions, we do so on the basis of Standard Contractual Clauses. You are entitled to request a copy of our Standard Contractual Clauses using the contact details provided in Section (R) below.
Please note that when you transfer any Personal Data directly to a Giant entity established outside the EEA, we are not responsible for that transfer of your Personal Data. We will nevertheless Process your Personal Data, from the point at which we receive those data, in accordance with the provisions of this Notice.

Although we will implement all reasonable measures to protect your Personal Data, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk and you are responsible for ensuring that any Personal Data that you send to us are sent securely.

(a) we maintain an ongoing relationship with you (e.g., where you are a user of our Apps, or you are lawfully included in our mailing list and have not unsubscribed); or (b) your Personal Data are necessary in connection with the lawful purposes set out in this Notice, for which we have a valid legal basis (e.g., where your personal data are included in a contract between us and your employer, and we have a legitimate interest in processing those data for the purposes of operating our business and fulfilling our obligations under that contract; or where we have a legal obligation to retain your Personal Data), plus:
(2) the duration of: (a) any applicable limitation period under applicable law (i.e., any period during which any person could bring a legal claim against us in connection with your Personal Data, or to which your Personal Data are relevant); and (b) an additional two (2) month period following the end of such applicable limitation period (so that, if a person brings a claim at the end of the limitation period, we are still afforded a reasonable amount of time in which to identify any Personal Data that are relevant to that claim), and:
(3) in addition, if any relevant legal claims are brought, we continue to Process Personal Data for such additional periods as are necessary in connection with that claim.

During the periods noted in paragraphs (2)(a) and (2)(b) above, we will restrict our Processing of your Personal Data to storage of, and maintaining the security of, those data, except to the extent that those data need to be reviewed in connection with any legal claim, or any obligation under applicable law.
Once the periods in paragraphs (1), (2) and (3) above, each to the extent applicable, have concluded, we will either:
permanently delete or destroy the relevant Personal Data; or
anonymize the relevant Personal Data.

(S) Definitions
“App” means any application made available by us (including where we make such applications available via third party stores or marketplaces, or by any other means).
“Adequate Jurisdiction” means a jurisdiction that has been formally designated by the European Commission as providing an adequate level of protection for Personal Data.
“Cookie” means a small file that is placed on your device when you visit a website (including our Sites). In this Notice, a reference to a “Cookie” includes analogous technologies such as web beacons and clear GIFs.

“Profiling” means any form of automated Processing of Personal Data consisting of the use of Personal Data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
“Relevant Personal Data” means Personal Data in respect of which we are the Controller.
“Sensitive Personal Data” means Personal Data about race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, physical or mental health, sexual life, any actual or alleged criminal offences or penalties, national identification number, or any other information that are deemed to be sensitive under applicable law.

Your order contains one or more products that are currently not in our warehouse but are expected to arrive around the expected date that is displayed in your shopping cart.
