These Terms & Conditions apply to the Giant Bicycles Australia ‘2023 MTB Sale’ promotion (the “Promotion”):

2. The Promotion commences at 00:00 AEST on Friday 1/9/2023 and closes at 23:59 AEDT on Sunday 1/10/2023. Discounts will only be valid during this time (the “Promotional Period”).

Giant AU:

3. The Promotion offer is a discount of up to 45% on select Giant-branded mountain bike models purchased online or in-store through participating retailers during the Promotional Period. This offer cannot be used in conjunction with any other discount or promotion or be applied retrospectively.
4. Promotion discounts only apply to online sales placed through giant-bicycles.com/au, liv-cycling.com/au, and through participating retailers. Promotion discounts do not apply to purchases placed on any other website(s).
5. Any discount(s) will automatically be applied to online sales (website pricing during the Promotion reflects the discounted price).
6. Any sale items reduced prior to the Promotion commencing will not receive any further discounting.
7. There is no purchase limit during the Promotion. Items available only while stocks last. Items will be allocated on a first-come-first-served basis. No rain checks.

The following schedule lists all eligible Giant and Liv-branded bicycles for this Promotion.

General Terms & Conditions

Introduction

1. By submitting an entry into this Promotion, entrants warrant that they have read, understand and agree to be bound by these Terms & Conditions and the Terms & Conditions Schedule (the Schedule), including any instructions relating to the Promotion on the Promoter’s Website.
2. Any capitalised terms used in these General Terms & Conditions have the meaning given in the Schedule unless stated otherwise. In the event of any inconsistency between the Schedule and these General Terms & Conditions, the Schedule will take precedence.
3. The Promoter may in its absolute discretion refuse to award any Prize to any entrant who fails to comply with these Terms & Conditions.
4. The Promotion is a game of random chance.

Entry Restrictions

6. Eligibility to enter the Promotion is subject to the Entry Restrictions. Each entrant of the Promotion must be an individual and not a company or organisation. Directors, immediate family members, employees and contractors of the Promoter and any agencies, retailers and suppliers directly associated with the Promotion, or with the provision of the Prize, are not eligible to enter.

Promotional Period

7. The Promotion will be conducted during the Promotional Period. Any entry received after the expiry of the Promotional Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.

Method of Entry

8. To enter the Promotion, entrants must enter the Promotion in accordance with the Method of Entry, and any other entry details provided by the Promoter on the Website, during the Promotional Period.

Maximum Number of Entries

9. Entrants can enter the Promotion up to the Maximum Number of Entries. Entries must be submitted separately and each entry must individually meet the requirements in the Schedule and are subject to the Entry Restrictions.

Prize Draw

10. If a Prize is awarded by draw, all entries received in the Promotional Period will go into a random draw and the Prize Draw will be conducted in accordance with the details in Prize Draw of the Schedule. The first valid entry randomly drawn will win a Prize. If the winning entry is invalid, that entry will be disregarded and the Prize will be awarded by drawing the next valid entry in accordance with these Terms & Conditions.

Prize Details

11. The Prize will be awarded as specified in the Schedule. The Total Prize Pool value is specified in the Schedule. The Prize values are the recommended retail value as provided by the relevant supplier, are in Australian dollars and are correct as at the time of the commencement of the Promotional Period. The Promoter accepts no responsibility for any variation in the Prize value.

Prize Restrictions

12. Unless otherwise specified in the Schedule, the Promoter will not be responsible for any additional costs or expenses associated with the collection and/or use of the Prize. The Prize Winner is responsible for all costs associated with collecting and/or using the Prize.
13. Any tax payable as a result of a Prize being awarded or received will be the responsibility of the Winner. Winners should seek independent financial advice prior to accepting a prize if this is a concern.
14. No component of the Prize can be transferred or exchanged.
15. It is a condition of accepting the Prize that the Winner (and any guests participating in using the Prize) must comply with all the conditions of use of that Prize and the Prize supplier’s requirements.
16. As a condition of accepting the Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Winner Notification:

17. All Prize Winner(s) will be notified directly, by written means (email, mail, fax, or SMS) within seven (7) days of the Prize Draw, as well as by any other means of communication set out in the Schedule. Please allow at least twenty-eight (28) days from the date of notification for the delivery of the Prize.

Unclaimed Prize Redraw

18. In the event that a Prize Winner is unable to be contacted, the Promoter will retain the Prize for three (3) months from the date of the Prize Draw. If the Prize is not claimed within three (3) months of the date of the Prize Draw, the Promoter will redraw another winner for the unclaimed Prize through an Unclaimed Prize Redraw.
19. The Unclaimed Prize Redraw will be conducted in accordance with the details as specified under Unclaimed Prize Redraw in the Schedule as well as set out under section 10. Prize Draw in these Terms & Conditions. Unclaimed Prize Redraw winners will be notified as set out in Winner Notification in the Schedule.

Unclaimed Prizes

20. Prizes unclaimed after a period of three (3) months after the Unclaimed Prize Redraw will be forfeited subject to State Regulations and any express provisions contained in the Schedule.

Personal Information and Privacy

21. The Promoter will collect your Personal Information, including name, email and phone number, for the purposes of conducting the Promotion. In doing so, the Promoter may disclose your Personal Information to its contractors, agents, any partner or co-promoter and to State and Territory gaming departments. Prize winners’ names may be published as set out in these Terms & Conditions.
22. By entering the Promotion, entrants consent to the use of their Personal Information for promotional, publicity and marketing purposes of the Promoter (including for direct marketing), and any other purposes as specified in the Schedule, without any further reference, payment or other compensation to the entrant.
23. Additional information about how Personal Information is collected, used and disclosed, how to request access to your Personal Information, and the privacy complaints process is available in the Promoter’s Privacy Policy, as specified in the Schedule.

This clause applies where the promotion is operated or promoted via Facebook.

Governing Law and Jurisdiction

32. This Promotion is governed by the laws of Victoria. Entrants submit to the jurisdiction of the courts of that State.

General

33. Any attempt to interfere with the normal functioning of the Website or to otherwise undermine the legitimate operation of this Promotion is prohibited and will render all entries submitted by that entrant invalid.
34. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
35. You warrant that:
    1. all details provided with your entry are true and accurate;
    2. you have all necessary rights to grant the Promoter the rights granted under these Terms & Conditions;
    3. use of your entry by the Promoter, in accordance with these Terms & Conditions, will not infringe the rights of any third parties; and your entry does not breach any law.
36. You agree to indemnify the Promoter against any loss or damage resulting from any breach of the warranties above and acknowledge that the Promoter may, in its absolute discretion, not award the Prize to you for breach of the warranties above.
37. If there is any event that prevents or hinders the Promoter’s conduct of the Promotion or the Promoter’s ability to deliver the Prize to the Prize winner(s) the Promoter may, in its discretion, cancel the Promotion and recommence it at another time under the same conditions or select another winner.
38. The Promoter is not responsible for any incorrect or inaccurate information, or for any failure of the equipment or programming associated with or utilised in the Promotion, or for any technical error that may occur in the course of the administration of the Promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer networks and systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of them, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
39. To the full extent permitted by the law, the Promoter will not be liable for any delay, death, injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Promotion or accepting or using any Prize, including without limitation non-receipt of any Prize or damage to any Prize in transit and the Prize winner’s failure to comply with the terms and conditions (if any) specified by any third party.
40. If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the Promotion without liability to any entrant or other person, subject to State Regulations. The Promoter will not award prize(s) if the Promotion is terminated.
41. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion, subject to State Regulations, cancel the Promotion and recommence it from the start on the same conditions at a later date.
42. Failure by the Promoter to enforce any one of these Terms & Conditions in any instance(s) will not give rise to any claim or right of action by any other person or entrant.
